1. Who We Are

NovaStorm IT SRL ("NovaStorm," "we," "us," "our") respects your right to privacy and is committed to protecting your personal information. This Privacy Policy explains who we are, how we collect, use, share, and protect personal information about you, and how you can exercise your privacy rights.

This Privacy Policy applies to personal information that we collect through our website (the "Website," available at www.novastormit.com), our algorithmic trading software, licensing and telemetry systems, dashboards, and related support and communication channels (together, the "Services").

NovaStorm acts as a controller for the personal data it processes in connection with providing and marketing the Services, except where we act strictly on behalf of a client or partner as a processor, in which case this will be clarified in a separate agreement.

If you have any questions or concerns about our use of your personal information, you can contact us using our contact form.

2. What NovaStorm Does

NovaStorm is a software development company that designs and provides algorithmic trading software and related tools for use with third-party trading platforms and brokers. Our software automates trade execution based on predefined algorithms and settings chosen by the user.

NovaStorm does not execute trades as broker or dealer, does not hold client funds, and does not provide personalized financial or investment advice. Our role is limited to providing software and technical infrastructure that clients may use at their own discretion and under their own responsibility.

3. What Personal Information We Collect

The personal information that we collect about you falls into three main categories: information you provide to us, information we collect automatically, and information we receive from third parties.

3.1 Information You Provide Voluntarily

When you interact with the Website or Services, you may provide personal information such as your name, email address, postal address, telephone number, and other contact details. This typically occurs when you register an account, request information, subscribe to a Service, schedule a call or demo, or communicate with our support team.

You may provide personal information when you complete forms on the Website, respond to surveys for research or product-improvement purposes, or participate in webinars, events, or educational content hosted by NovaStorm.

You may send us correspondence, including emails, chat messages, screenshots, log files, and other supporting materials when requesting support or reporting a problem. These communications may contain personal information and technical details about your use of the Services.

If you purchase a paid Service or subscription, we collect necessary information to process the transaction, such as name, contact details, and billing details. Payment card data is collected and processed through secure third-party payment processors; NovaStorm does not store full payment card numbers on its own systems.

3.2 Information We Collect Automatically

When you visit the Website or use the Services, we may automatically collect certain information about your device and your usage of the Website. In some jurisdictions this information is considered personal data.

This information can include details about your visits to the Website and use of the Services, such as pages viewed, links clicked, access times, referring and exit pages, and the resources and features you access.

We may collect information about your device, computer, or network connection, such as IP address, operating system, browser type, device identifiers, language and time zone settings, and internet service provider or mobile operator.

We may use cookies and similar technologies to collect some of this information. A cookie is a small data file placed on your device that helps us recognize your browser, remember your preferences, and understand how you use the Website. You can manage your cookie settings in your browser. If you reject or disable cookies, some features of the Website may not function properly.

3.3 Information We Obtain from Third Parties

From time to time, we may receive personal information about you from third-party sources, such as payment processors, referral partners, brokers, white-label partners, or marketing platforms. We receive such information only where these third parties are legally permitted to share it with us.

The information we receive may include your name, contact details, payment status, account identifiers, and limited trading or usage data that relates to your use of NovaStorm software. We use this information to facilitate onboarding, verify subscriptions or licenses, reconcile usage-based billing, provide support, and maintain the accuracy of our records.

4. Advertising, Cookies, and Tracking Technologies

NovaStorm may use online advertising and marketing tools to promote its Services, including advertising on third-party platforms such as search engines, social networks, and partner websites.

To understand how our campaigns perform and to improve our marketing, we may work with advertising and analytics providers who use cookies, pixels, and similar technologies to measure impressions, clicks, conversions, and audience characteristics in an aggregated manner.

Where required by law, we will request your consent before placing non-essential cookies and similar tracking technologies on your device. You can withdraw this consent at any time through your browser settings or any cookie management tools we provide.

Your browser may offer "Do Not Track" or similar preferences. Standards for these signals are not yet uniform, and at present our Website may not respond to all such signals. You may still control many aspects of tracking via your own browser or device settings and cookie choices.

5. How We Use Your Personal Information

We use the personal information we collect about you for the following purposes:

  • For any other purpose that we describe to you at the time of collection or for which we obtain your consent

6. Legal Bases for Processing (EEA/UK)

If you are located in the European Economic Area or the United Kingdom, our legal bases for processing your personal information will typically be one or more of the following:

  • Performance of a contract: for example where we process your personal data to create and maintain your account, provide the Services, and fulfill our contractual obligations
  • Legitimate interests: for example to improve and secure our Services, manage our relationship with you, prevent misuse, and defend our legal rights, provided that such interests are not overridden by your fundamental rights and freedoms
  • Compliance with legal obligations: for example where we are required to keep certain records for tax, accounting, or regulatory purposes
  • Consent: for example where we send you certain types of marketing communications or place non-essential cookies on your device. You can withdraw your consent at any time, without affecting the lawfulness of processing before withdrawal

7. How and With Whom We Share Your Personal Information

We do not sell your personal information to unaffiliated third parties. We may share your personal information with trusted recipients in the following situations:

  • We share personal information with contractors, service providers, and vendors who support our business and help us deliver the Services, such as payment processors, hosting providers, IT and security services, email and communication tools, analytics providers, and CRM systems. These parties are bound by contractual obligations to use your personal information only on our instructions and to protect it appropriately
  • We may share information as necessary to fulfill the purpose for which you provided it. For example, when you authorize an integration with a broker, VPS provider, or partner service, we may exchange limited data to enable that integration
  • In the event of a merger, acquisition, reorganization, sale of assets, or similar corporate transaction, your personal information may be transferred to the acquiring or successor entity as part of the transaction, subject to this Privacy Policy and applicable law
  • We may disclose personal information where required to comply with a legal obligation, court order, or request from governmental or regulatory authorities with appropriate jurisdiction, or to protect the rights, property, or safety of NovaStorm, our clients, or others
  • We may disclose personal information to legal, tax, or professional advisors where necessary for the establishment, exercise, or defense of legal claims or for compliance and governance purposes
  • We may share personal information with others when you have given your explicit consent to such sharing, or when you direct us to do so

8. Data Security

The security and confidentiality of your personal information are important to us. We implement appropriate technical and organizational measures designed to protect your personal information against unauthorized access, loss, misuse, alteration, or destruction. These measures may include encryption, access controls, secure hosting, logging and monitoring, and regular security reviews.

While we strive to protect your personal information, no system can be guaranteed to be completely secure. You are responsible for maintaining the confidentiality of your account credentials and for controlling access to your devices and accounts.

9. International Data Transfers

NovaStorm may process and store your personal information in countries other than your country of residence. Our servers and some of our service providers may be located outside the European Economic Area or the United Kingdom.

Where we transfer personal data from the EEA or UK to countries that have not been recognized as providing an adequate level of data protection, we will implement appropriate safeguards, such as standard contractual clauses approved by the European Commission or the UK regulator, or rely on another lawful transfer mechanism, in order to protect your personal data.

You can contact us for more information about the specific transfer safeguards we use for international data transfers.

10. Data Retention

We retain your personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, including providing the Services, complying with legal obligations, resolving disputes, and enforcing agreements.

The specific retention period for different categories of data may vary depending on the nature of the information and our legal or regulatory obligations. When personal information is no longer required for the purposes for which it was collected, we will either delete it, anonymize it, or securely store it and isolate it from further use until deletion is possible.

11. Minors

The Website and Services are not intended for children or minors. We do not knowingly collect personal information from children under the age of 16, or under the minimum age required by applicable law in your jurisdiction.

If we become aware that we have collected personal information from a child under the relevant age threshold without appropriate consent, we will take steps to delete that information as soon as reasonably possible.

12. Your Data Protection Rights

Depending on your location and subject to applicable law, you may have certain rights in relation to your personal information. These rights may include:

  • The right to request access to your personal data
  • The right to request correction (rectification) of inaccurate or incomplete data
  • The right to request deletion (erasure) of your data
  • The right to request restriction of processing
  • The right to object to certain types of processing
  • The right to data portability where applicable

Where we process your personal information based on your consent, you have the right to withdraw that consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.

To exercise any of these rights, you can contact us using our contact form. We may need to verify your identity before responding to your request.

If you are located in the EEA or the UK, you also have the right to lodge a complaint with your local supervisory authority if you believe that we have processed your personal data in a way that violates applicable data protection laws. We would, however, appreciate the chance to address your concerns before you approach a regulator, so we encourage you to contact us first.

We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or other factors.

When we make material changes, we will post the updated Privacy Policy on the Website and update the "Last updated" date at the top. Where required by law, we may also notify you more directly and, where necessary, request your consent to significant changes.

Your continued use of the Website or Services after the effective date of any changes constitutes your acceptance of the updated Privacy Policy.
